LEGAL FRAMEWORK FOR MEDIA IN LUXEMBOURG
Luxembourg has a differentiated legal framework that provides specific regulations depending on the medium and combines national laws with European directives to meet the demands of a modern media environment.
Print Media
In the field of print media, the Loi du 8 juin 2004 sur la liberté d’expression dans les médias is authoritative, supplemented by the amendments of the Loi du 11 avril 2010. These laws establish the legal framework for press freedom and editorial due diligence, define content boundaries, and protect freedom of expression. Additionally, older provisions such as the Loi du 23 mai 1927 regulate specific aspects, such as the handling of obscene publications, thereby contributing to comprehensive legal protection.
Electronic media and broadcasting
For electronic media and broadcasting, the Loi du 27 juillet 1991 sur les médias électroniques forms the foundation. This law creates the legal conditions for electronic communication services and is supplemented by the Règlement grand-ducal du 28 juillet 2014, which, among other things, regulates the allocation of broadcasting frequencies. This ensures fair competition and consumer protection. As a member of the European Union, Luxembourg also implements European guidelines, particularly Directive (EU) 2018/1972, which establishes the European Electronic Communications Code and harmonizes national regulations.
Audiovisual media
In the area of audiovisual media, the Loi du 22 septembre 2014 plays a central role. It promotes national audiovisual production and adapts financial support mechanisms, such as the national promotion fund, to current market conditions.
IMAGES OF PRIVATE INDIVIDUALS
During events, it is unavoidable that visitors or participants are depicted in photographs. The resulting processing of personal data falls under the provisions of Art. 85(2) GDPR and Art. 5 of the Constitution, which permit such processing for journalistic purposes.
Pursuant to the right to object,,we offer to anonymize individuals in images provided we receive proof that the person depicted in the photo is the one submitting the objection. We ask that objections to depiction be submitted via our contact form.
We strive to protect the data and personality rights of all involved parties and are committed to responding quickly and responsibly to inquiries and concerns regarding the use of photographic material.
IMAGES OF YOUTH AND CHILDREN
Images of youth and children on our website are only published with the express written consent of their legal guardians. We ensure that the personality rights and protection of minors are upheld. Should you not wish for your child’s image to be published, please contact us immediately, and we will remove the affected images without delay.
