ONLINE SHOP AND DISTANCE CONTRACTS

LUXBD operates an online shop for association products (e.g. magazines, merchandise, donation products). The shop will be operated by the future ASBL LUXBD (establishment expected on 01 February 2026) and is subject to Luxembourg law.

Value Added Tax (VAT)
As an ASBL, we use the VAT exemption pursuant to Art. 48 of the amended Law of 12 February 1979 on value added tax. As long as our annual turnover does not exceed €35,000, we are exempt from VAT. Therefore, no Luxembourg VAT is shown and no VAT identification number is provided. If the threshold is exceeded, we will immediately register with the Registration, Estates and VAT Administration (AED) and charge VAT.

Prices and payment
All prices quoted are final prices (no VAT pursuant to exemption). Shipping costs are shown separately in the shopping cart. Accepted payment methods: [e.g. PayPal, credit card, transfer].

Right of withdrawal and return
Consumers have a statutory right of withdrawal of 14 days from receipt of the goods (Law of 31 July 2006 on electronic commerce, implementing CRD 2011/83/EU). The complete withdrawal instructions and the model withdrawal form can be found on the separate "Right of Withdrawal" page as well as in the shop's General Terms and Conditions (GTC).

General Terms and Conditions (GTC)
All orders are exclusively subject to LUXBD's GTC in the respective current version (available in the shop footer and at checkout).

Contract language
The contract languages are German, French and English (DE/FR/EN). The versions of the GTC and withdrawal instructions in the language selected by the customer apply (for multilingual offers).

COPYRIGHT, RIGHTS OF USE AND CREDITS

Publisher and sole rights holder
LUXBD (currently the project, from 01.02.2026 at the earliest the LUXBD asbl) is the publisher and sole holder of all rights of use to all content published on this website, in particular:

  • editorial texts (articles, reviews, descriptions, comments)
  • own photographs, scans and images
  • other visual content created by contributors

Every contributor (author, photographer, editor) transfers, upon provision and publication, irrevocably, exclusively and without spatial or temporal limitation, all exploitation and usage rights to LUXBD. The naming as author or photographer is for journalistic transparency and does not change LUXBD's full ownership of rights.

Third-party image rights
Cover images, book and comic excerpts, drawings, promotional images, film and game stills, photographs, displayed logos or parts thereof, as well as registered trademarks remain the property of the respective publishers/rights holders and are used exclusively for editorial quotation and identification purposes (Art. 5 and Art. 10 Law of 18 April 2001).

Licensing and reprint
Any use of LUXBD content (texts, own photos, graphics) outside this website – even non-commercial – is only permitted with written permission from LUXBD. Requests for reproduction and reprint rights should be directed to luxorr a.s.b.l.

ONLINE DISPUTE RESOLUTION (ODR)

For consumer disputes from online contracts (e.g. purchases in the planned LUXBD magazine), the central EU ODR platform has been unavailable since 20 July 2025 (Regulation (EU) 2024/3228). Instead, disputes can be resolved via recognised national dispute resolution bodies (ADR-Entities) in Luxembourg.

LUXBD does not currently participate in ODR proceedings but is willing to settle disputes amicably. Complaints can also be asserted in court (see jurisdiction).

IMAGES OF PRIVATE INDIVIDUALS, CHILDREN AND ADOLESCENTS

Images of private individuals, especially of children and adolescents, are considered personal data pursuant to the General Data Protection Regulation (GDPR) and the Luxembourg law of 1 August 2018. Any publication takes place exclusively with the explicit, informed and revocable consent of the depicted person or, for minors under 16 years, with the consent of the legal representatives. Consents are documented and implemented immediately upon request (e.g. deletion). Images serve exclusively editorial purposes and are anonymised where possible. Affected persons can at any time request information, rectification, erasure or objection under contact@luxbd.info. Complaints are to be directed to the CNPD, 15 Boulevard du Jazz, L-4370 Belvaux.

MEDIA LAW FRAMEWORK IN LUXEMBOURG

General legal framework and supervision
LUXBD is subject to Luxembourg media law, which transposes EU Directive 2000/31/EC (E-Commerce Directive) and is supplemented by the Law of 8 June 2004 on freedom of expression and information in the written press and the amended Law of 30 May 2005 on electronic telecommunications. Supervision lies with the CNPD (data protection) and the Autorité luxembourgeoise indépendante de la presse (ALIA) for journalistic standards; upon entry into force of Law No. 8625 (draft bill submitted on 30 September 2025 and presented on 7 October 2025), the new Autorité luxembourgeoise indépendante des médias (ALIM) will be introduced as the unified regulator for all media forms, including print media, electronic media, broadcasting and audiovisual media.

Status as a future ASBL
As a future ASBL (established expected on 01 February 2026) and non-profit initiative with commercial elements (e.g. LUXBD magazine), we are considered a media provider under editorial responsibility; we commit to independent reporting without covert advertising and will register with ALIA/ALIM as soon as Law 8625 enters into force.

Print media
Specifically for print media, the Law of 8 June 2004 regulates freedom of expression in printed publications such as our planned commercial LUXBD magazine, with a focus on transparency, advertising labelling and protection of journalistic sources, whereby ASBLs like LUXBD must register with ALIA/ALIM if content is reproduced or distributed offline.

Electronic media
Electronic media, including online platforms, websites and newsletters such as our planned LUXBD newsletter, fall under the Law of 27 July 1991 on electronic media (amended 2021), which sets rules for advertising, sponsorship and content responsibility, supplemented by the European Media Freedom Act (EMFA, Regulation (EU) 2024/1083, fully applicable since 08.08.2025), which strengthens media pluralism and independence in digital services and imposes transparency obligations (e.g. ownership structures) on ASBLs like us.

Broadcasting (future linear audio/video offerings)
Broadcasting, i.e. linear radio and television broadcasts via terrestrial, satellite or cable, is also regulated by the Law of 1991, with licensing requirements for frequency use and content quotas (e.g. 30% European productions for on-demand services), whereby LUXBD as a text- and image-based platform does not directly meet these requirements, but must observe them for potential audio or video extensions (e.g. podcasts) and could apply for a licence with ALIA/ALIM as an ASBL.

Audiovisual media (videos, podcasts with music)
Audiovisual media, encompassing TV, on-demand services, video-sharing platforms and podcasts with music such as our planned online videos and podcasts, are subject to the EU Audiovisual Media Services Directive (AVMS D2010/13/EU, implemented in the Law of 1991), which prescribes youth protection, advertising restrictions and neutrality in news content; Law 8625 will unify this in future with print and electronic media, prohibits subliminal advertising, extends obligations for influencers and platforms to all formats to create a technology-neutral framework, and explicitly requires ASBLs like LUXBD to register all media content (including videos with music under SACEM regulations for rights granting) as well as compliance with quotas and youth protection measures.

Pursuant to Art. 14 of EU Directive 2000/31/EC (implemented in the Law of 30 May 2005), we are not liable for the content of linked pages. Liability arises only upon positive knowledge of unlawful content and if removal of the link is reasonable. Upon knowledge, such links will be removed immediately.

Reviews reflect subjective, independent opinions and are protected by freedom of the press (Law of 8 June 2004). They do not replace professional advice; liability for opinions or their consequences is excluded. Unsolicited manuscripts, texts, images or ideas are not remunerated and may be rejected or archived without feedback. LUXBD accepts no liability for loss or unwanted use of unsolicited submissions. The masculine or feminine language form used in our texts serves easier readability. All genders (m / f / d) are always meant.
